Judge must open jury selection in Maine Zumba case

ALFRED, Maine (AP) ? The remaining jury selection must be open to the public in the trial of the first major figure in a prostitution scandal centered on a Zumba studio in Kennebunk, Maine's highest court ruled Thursday.

Remaining members of the jury pool were sent home after the Maine Supreme Judicial Court stopped the process in response to a request by the parent company of The Portland Press Herald. In a 6-1 ruling, the state Supreme Court later ordered the remainder of the process in York County Superior Court to be opened to the public.

No jurors had been seated out of the original pool of about 140.

Mark Strong Sr., 57, of Thomaston, faces 59 misdemeanor counts including conspiring with dance instructor Alexis Wright, who's accused of using her Kennebunk fitness studio as a front for prostitution.

Justice Nancy Mills had been conducting questioning of potential jurors behind closed doors because of potentially embarrassing questions focusing on views on sex acts, pornography and prostitution.

But the high court said that wasn't reason enough to close the proceedings.

"The matter is remanded for the trial court to conduct the remaining voir dire in a presumptively public manner, exercising its considerable discretion to prevent the dissemination of sensitive juror information," Chief Justice Leigh Saufley wrote.

With potential jurors sent home, the judge weighed several pretrial motions, including one asking the judge to dismiss 47 of the counts related to invasion of privacy of accused prostitution clients who were allegedly videotaped without their knowledge.

Defense lawyer Daniel Lilley told the judge that people engaged in criminal activity have no right to privacy under a state law aimed at protecting privacy of people in restrooms, locker rooms and dressing rooms.

"The statute doesn't protect criminals and make criminals victims," Lilley said, telling the judge that the charges would make Maine "the laughingstock of jurisprudence."

Mills didn't immediately rule on the motion.

Responding to other requests, Mills said she'll allow the defense to explore possible bias of an investigator from the Kennebunk Police Department, but won't allow the defense to cast the case as a David versus Goliath scenario with regards to the vast resources used to target Strong, an insurance agent.

Mills also ordered the state to turn over letters that were sent to accused prostitution clients. Lilley contends prosecutors sweetened plea bargains to ensure convictions of 18 men in time for them to testify against Strong.

The married insurance agent has acknowledged having a physical relationship with Wright after helping her launch her Pure Vida fitness studio by co-signing for her lease and loaning money that was repaid with interest. He said he was unaware of any allegations of prostitution, and that he did nothing wrong.

Police said Wright videotaped many of the encounters without her clients' knowledge and kept records suggesting the sex acts generated $150,000 over 18 months.

Wright, for her part, faces 106 counts including prostitution and invasion of privacy for acts performed in her dance studio and in the rented office. She'll be tried at a later date.

Emails from former Apple CEO Steve Jobs, ?published below, are at the center of a lawsuit that that connects the tech industry's most powerful executives and companies.

Five tech workers are suing Apple, Google, and Intel.

They say that top executives at these companies agreed to not hire each other's employees.

According to the Telegraph, they are accusing the companies of?an illegal conspiracy to eliminate competition for each other's employees and drive down wages."

To make their case, the suing tech workers have cited internal emails between these executives, including some from Steve Jobs to the heads of companies caught trying to hire Apple employees.

These emails have been made public, and The Verge published some of them.

They reveal Jobs to be a man comfortable making threats to rivals.

In this email, Jobs tells a Palm executive that he should stop recruiting Apple employees because "I'm sure you realize the asymmetry in the financial resources of our respective companies."

In this email thread, which starts at the bottom and moves up chronologically, Steve Jobs complains to former Google CEO Eric Schmidt about a Google recruiter contacting an Apple engineer. Schmidt forwards the email on to a Google HR executive, who reports back that the recruiter will be terminated. Schmidt asks the executive to make "a public example of this termination."

In this email thread, which again starts chronologically at the bottom of this image, a Pixar recruiter asks Jobs if it is OK to hire a non-engineer from Apple. Jobs says its OK, and then warns: "The key is to stay away from engineers."

Rio Favela Transformed Into Prime Real Estate - Business Insider

Until recently, the most high-profile conflict in Rio de Janeiro's favelas has been between rival gangs fighting turf wars: now it is European investors tussling over a piece of prime real estate.

High on the steep slopes of Vidigal, the panorama across Atlantic beaches and distant islands is among the most spectacular in Rio, but tourists are unlikely to find it listed in most guidebooks.

The hillside shanty town was dominated by drug traffickers and widely considered off-limits among middle-class people.

But the favela is undergoing a transformation as the police have taken control of the streets and investors have pushed up the price of the land.

With gangs no longer deciding who enters their territory, rental prices have surged more than threefold in three years. Wealthy buyers are snapping up the prime plots, real estate companies are opening offices and more outsiders are moving in.

Andreas Wielend, an Austrian engineer, bought a dilapidated home in 2009 and turned it into a hostel and nightclub. It is now famed for breathtaking views and holding dub and electronic music nights that attract several hundred customers to party until dawn. The change is dramatic, but not entirely for the better.

"When we first came here, there were 15 guys with heavy machine guns next door. It was like a war zone. There was no water or electricity," he recalls. "Then the police came in and the house prices went up ? It was more relaxed before because you didn't constantly have real estate speculators approaching you all the time."

His neighbourhood has suddenly become one of the most fashionable in Rio. Less than 100 metres away, a hotel is under construction, reportedly financed by two of the city's wealthiest denizens.

A lawyer from S?o Paulo has snapped up three houses next door. Local gossip is thick with rumours that Hollywood stars Brad Pitt and Angelina Joli have brought land nearby.

Wielend's property cost him 34,000 reals (about ?10,000). Now he says he is getting offers of a million reals to sell. The dramatic inflation of values has prompted a ownership battle between him and the German banker who sold him the land.

Last year, Wielend returned from an overseas trip to find the former owner had seized the house, changed the locks and denied that a sale had been made. Wieland has since persuaded the police that he is the rightful owner and taken legal action.

The strains are not unique to this one plot in Vidigal, he says. "Now there are many houses here where people are fighting for ownership, even among families."

Take away the paramilitary campaign against the traffickers and what is happening is similar to the gentrification seen in cities such as New York, London, Berlin and Beijing.

Nicola Tadini, a researcher who is studying the process, said it was a mixed blessing for the community in Videgal, many of whom ? as with most of Rio's favelas ? are from poor families that migrated from north-east Brazil.

"This is a long-term change. The World Cup and Olympics are pushing the process. People are investing. Locals can rent their rooms out for more than three times as much as they could three years ago. The little shops on the street are doing more business with tourist customers. Some people are selling their homes here and buying big properties back in the north-east," said Tadini.

"For now, people are happy with the way things are going because they are making more money. But the gentrification will change this community. Instead of neighbour and neighbour, you are starting to see employer and employee."

Among Rio's thousand or so favelas, Vidigal was always somewhat special thanks to its spectacular views, long history and attraction for artists. But it is seen as an indicator of what could happen to the other 39 slums that have been "pacified", or will be by 2014.

The average house price in Rio has increased by 165% over the past three years, according to the UN. Values have risen faster in favelas where the drug traffickers have been pushed out of sight. According to SecoviRio, an association of local real estate agents, property prices rose 50% in the first week after the initial three favelas were taken by police.

Changes are still at a very early stage and are different from favela to favela, as are the responses of locals to the armed police who patrol the roads and narrow alleys between their homes. While the majority of inhabitants that the Guardian spoke to were pleased about improved security and social services, several also expressed unease that they may be forcibly relocated or priced out of their homes.

Rocinha ? Brazil's biggest slum with at least 70,000 inhabitants ? is still far from being gentrified. But a real estate agent, who declined to give his name, said the rental price for a two bedroom home had doubled in the past year to 900 reals a month because more outsiders were moving in.

The authorities have ambitious plans to improve life in the favela, but their priorities have been questioned.

Rocinha now has a new library, where residents can borrow books or watch DVDs on plasma screens, a half-completed eco-park, a tennis court that opened last year and a concrete bridge to the community's sports centre that was designed by the country's most famous architect, Oscar Niemeyer.

But nothing has been done about the stinking open sewers that run through the densely packed community and overflow whenever there is heavy rain. Education and public health provision are also at dire levels. Tuberculosis and dengue fever are rampant. Many people still live in rudimentary shacks with irregular or no water supplies.

"The library and bridge are all very well, but you have to ask if this is the best use of social resources when there are still kids playing in shit and piss," said Lea Rekou, an co-ordinator of the Green My Favela NGO, which works with the local community to replace rubbish tips with vegetable gardens.

Instead of improving the environment for the sake of gentrification or beautification before the World Cup and Olympics, she says the most needed transformation is in attitudes.

"Pacification has opened up a space. You don't need to be so wary. It's easier to relax," she said. "But my main interest is in changing the way the middle class see the favelas ? that they need to be controlled and heavily policed."

A badly weakened Prime Minister Benjamin Netanyahu scrambled Wednesday to keep his job by extending his hand to a new centrist party that advocates a more earnest push on peacemaking with the Palestinians after Israel's parliamentary election produced a stunning deadlock.

The results defied forecasts that Israel's next government would veer sharply to the right at a time when the country faces mounting international isolation, growing economic problems and regional turbulence. While that opens the door to unexpected movement on peace efforts, a coalition joining parties with dramatically divergent views on peacemaking, the economy and the military draft could just as easily be headed for gridlock ? and perhaps a short life.

Israeli media said that with nearly all votes counted, each bloc had 60 of parliament's 120 seats. Commentators said Netanyahu, who called early elections three months ago expecting easy victory, would be tapped to form the next government because the rival camp drew 12 of its 60 seats from Arab parties that traditionally are excluded from coalition building.

A surprising, strong showing by a political newcomer, the centrist Yesh Atid, or There is a Future, party, in Tuesday's vote turned pre-election forecasts on their heads and dealt a setback to Netanyahu. Yesh Atid's leader, Yair Lapid, has said he would join a government only if it were committed to sweeping economic changes and a serious push to resume peace talks with the Palestinians, which have languished throughout Netanyahu's four-year tenure.

The results were not official, and the final bloc breakdowns could shift before the central elections committee finishes its tally early Thursday. With the blocs so evenly divided, there remains a remote possibility that Netanyahu would not form the next government, even though both he and Lapid have called for the creation of a broad coalition.

How Israeli elections work
Under Israel's parliamentary system, voters cast ballots for parties, not individual candidates. Because no party throughout Israel's 64-year history has ever won an outright majority of parliamentary seats, the country has always been governed by coalitions.

Traditionally, the party that wins the largest number of seats is given the first chance to form a governing alliance in negotiations that center around promising Cabinet posts and policy concessions. If those negotiations are successful, the leader of that party becomes prime minister. If not, the task falls to a smaller faction. President Shimon Peres has until mid-February to set that process in motion.

Netanyahu's Likud-Yisrael Beitenu alliance polled strongest in Tuesday's election, winning 31 parliamentary seats. But that is 11 fewer than the 42 it held in the outgoing parliament and below the forecasts of 32 to 37 in recent polls. Yesh Atid had been projected to capture about a dozen seats but won 19, making it the second-largest in the legislature.

Addressing his supporters early Wednesday, when an earlier vote count gave his bloc a shaky, one-seat parliamentary margin, Netanyahu vowed to form as broad a coalition as possible. Lapid also called for the formation of a broad government.

The goal will not be an easy one, however, and will force Netanyahu to make some difficult decisions. In an interview last week with The Associated Press, Lapid said he would not be a "fig leaf" for a hard-line agenda on peacemaking.

That stance could force Netanyahu to promise overtures to get peace negotiations moving again.

But a harder line taken by traditional and future hawkish allies could present formidable obstacles to coalition building.

Tensions with the United States, Israel's most important ally, also may have factored into the shift to Lapid. President Barack Obama was quoted last week as saying that Netanyahu was undermining Israel's own interests by continuing to build Jewish settlements on occupied lands the Palestinians want for a future state.

As Verizon?s brass is busy discussing the company?s recent earnings release, AT&T and the little-known Atlantic Tele-Network Incorporated have just gone and stolen some of their thunder. The two companies have just announced that they have inked a deal that will see AT&T acquire ATNI?s rural Alltel wireless business for a grand total of $780 million.

And what exactly will AT&T be getting in exchange for all the money? According to the release, the shopping list includes ?wireless properties, including licenses, network assets, retail stores and approximately 585,000 subscribers.? Those of you hoping for improved LTE coverage in Manhattan will likely be disappointed by the results of this acquisition ? Alltel currently only operates in Georgia, Idaho, Illinois, North Carolina, Ohio and South Carolina, so there?s little reason for anyone outside of those states to celebrate.

The situation may be a little confusing to those that have been following the growth and decline of wireless carriers in the U.S. (it?s surprisingly riveting stuff), especially because of how Alltel has already been picked apart by another major telco in recent years. Alltel provided wireless access for 34 states before Verizon swooped in and acquired the regional carrier for $28.1 billion back in 2008. Curiously, Verizon effectively had to ditch 105 Alltel?s service markets as part of that deal, prompting rival AT&T to make a move of its own and snap up 79 of them. The remaining 26 were acquired by Atlantic Tele-Network which has been keeping the service alive under the Alltel name and will continue to do so until the FCC gives this transaction its blessing (expected to happen sometime later this year).

Feud over budget for diplomatic security escalates

WASHINGTON (AP) ? A long-running feud over whether Congress provides enough money for protecting U.S. diplomats escalated Tuesday as the chairman of a Senate subcommittee charged that House Republicans "blithely torpedoed embassy security funds" in stripping a $1 billion measure sought by the State Department from a hurricane relief bill.

Sen. Patrick Leahy, D-Vt., made the accusation on the eve of departing Secretary of State Hillary Rodham Clinton's overdue appearance before the Senate and House Foreign Relations committees to testify about the Obama administration's handling of the September terrorist assault on the U.S. Consulate in Benghazi, Libya. U.S. Ambassador Chris Stevens and three other Americans were killed in the attack.

Since then, the fingerpointing has been rampant. Democrats have blamed Republicans for cutting diplomatic security spending too deeply. The GOP has argued that lapses in management and leadership, not a shortage of money, were the reasons State Department officials failed to see the threat.

Leahy, who chairs the Senate Appropriations subcommittee that oversees the State Department's budget, said the House deleted from the Senate's version of the Superstorm Sandy emergency relief bill an amendment he wrote at the department's request to shift up to $1 billion originally intended for U.S. operations in Iraq to be used for improving U.S. security at diplomatic outposts.

Senate leaders have planned a vote this week on the House's version of the $50 billion relief bill aimed primarily at helping residents and businesses as well as state and local governments rebuild from the late October storm that devastated coastal areas in the Northeast, particularly New York, New Jersey and Connecticut.

Jennifer Hing, a spokeswoman for the House Appropriations Committee, said any provisions not directly related to storm relief were removed from the bill to ensure its quick passage last week in the House ? two weeks after Speaker John Boehner incurred the wrath of New Jersey Gov. Chris Christie and other Northeast Republicans for not holding the vote on New Year's Day. Most House Republicans ended up voting against it anyway. The Senate passed its storm aid bill in late December.

Hing said the committee is not opposed to Leahy's amendment "and agrees that the safety and security of our diplomatic personnel and operations is of the utmost importance." The measure can and should be included in the next suitable piece of legislation, she said.

Leahy, however, said any delay in approving the transfer authority, even a short one, slows the State Department's ability to follow through on recommendations for improving diplomatic security made by an independent panel that reviewed the Benghazi attack.

"I know from personal experience that there are many thoughtful Republicans in positions of responsibility in the House who want to do the right thing," Leahy said. "Yet a small but apparently dominant obstructionist cadre within the Republican ranks seemingly is willing to push the bounds of irresponsibility to ever greater heights."

The independent review panel said serious lapses in management and leadership left the consulate badly unprepared, but it also called for a greater commitment from Congress to support the State Department's needs. State asked for close to $2.4 billion in its 2013 budget for overseas security. The transfer of as much as $1 billion would speed up the construction of more Marine security guard units at overseas posts, additional diplomatic security agents and for security upgrades and construction at new embassies.

Since 2007, Congress has increased spending by 27 percent, or roughly a half-billion dollars, on security at foreign diplomatic posts, according to the nonpartisan Congressional Research Service. Millions more were added over that period specifically for increased security in Iraq, Afghanistan and Pakistan.

But neither Congress nor the State Department added or sought additional spending specifically for security at U.S. posts in Libya despite growing instability in the country, the Senate Homeland Security and Governmental Affairs Committee said in a report in December on the Benghazi attack.
